Illegal demolition of my house at Azadliq av. 146/148, Baku, Azerbaijan


My house at Azadliq av. 146/148 was ILLEGALLY demolished by the governmental officials on 26 August 2011 after the Baku Appeal Court forbidden to demolish my house. Previously on 22nd June 2011 the 2nd Economic Court of Baku forbidden the government to demolish my house too. However, despite decision by courts on two separate occasions prohibiting demolishion of my apartment house, the government has demolished my house. Before demolishing my house the representatives of the government and/or the workers of the Azinko Holdinq company, which was ordered by the government to demolish the house, have opened the door of my apartment, entered in and stoolen all leftover household items. The CRIMINAL ACTIONS of the government officials should not be left unpunished. The government took this action after I did not agree to exchange my apartment to another apartment, offered by the government.

My house is being demolished after the president of the Azerbaijan Republic Mr. Ilham Aliyev has built his residence nearby and apparently he does not want to have me and other azerbaijani citizens who live in my house as his neighbours.The authorities also said that they wanted to make the city more beautiful for the Eurovision, which took place in Baku in 2012, and that is why they demolish  our houses. 


I have called police, but police did not take any action to protect my property. I wrote letters to local authorities, to the ministry of internal affairs, to the prosecutor of the Baku city, to the Ombudsman of Azerbaijan Republic, to the government of Azerbaijan Republic, to the President of Azerbaijan Republic. But they did not take any action to protect me and my rights.
The government officials offered all people in my house to sign a contract with the "Meredian R Kommersiya Sirkati" Company with limited liability and with 100 Manat registered capital. Why governmental offiicals force people to sign contract with a third party with a limited liability? I was at the address, where this company is registered. There is no a company at this address, but a simple apartment in an apartment house. A copy of three pages of this contract with hidden names and numbers of the apartments is presented below.

The government offered me to choose one of two apartments. The layout of these apartments can be here and here. The house was built by the Azinko Holdinq company.

The areas at the layout is 116,9 mē and 125,1 . This area is being counted illegally from the outside wall of the building. The real total area of the apartment is from 10% till 20 % less than stated at the layout and is about 100 - 112 mē.

 The total area of my apartment is 74,5 mē. I have also a storeroom with a total area of 8 mē, which is not presented in the plan above. The apartment, which is being offered by the government, has about 40% more area. But the quality of the new building is very bad, the area of the city is far from my previous house and is not so central. There is no green garden like in my old house. If I want to park a car I shall rent a place in the underground car park, which costs around 500 USD per year. Previously I could park near my house free of charge. From the windows of the new apartment I can only see the apartments of my neighbors. I am also not satisfied with the floor, which is being offered to me (only apartments at 15 till 22 floors are offered to me), but my old apartment is on the 2nd floor. The last but not least, people shall pay about 600 USD per year to the management company if they live in new apartments. These prices are not controlled by anyone and can rapidly increase in the future. In my old apartment I paid only about 30 USD per year. Also people, which receive new apartments, do not get a certificate of ownership, but simply sign a contract with above mentioned "Meredian R Kommersiya Sirkati" company. They loose their old apartments and do not become the owners of the new apartments.

On this photo my house is completely demolished. A person and a truck stand near the place where my apartment was situated. The excavator, which illegally demolished my house, continues demolition of the next house. This illegal action takes place in the center of the Baku city, the capital of the Azerbaijan Republic and is being supported by Azerbaijan authorities. On the opposite side of the street the residence of the president of Azerbaijan Republic Mr. Ilham Aliyev is situated.

Officials say that my house was demolished because of its poor condition. However my house was in a very good condition and was at the moment of demolition only 47 years old. My house was in a better condition than newly build apartment complex at Aliyar Aliyev 26 street. The government officials did not show me any of the documents, which would prove the poor condition of my house. It is also not the task of the government to destroy the decrepit houses. The owners of such houses should repair their houses themselves.
They are many decrepit houses in the Baku city, in which people live or work , that the government does not intend to demolish (see pictures below). However, the government officials in cooperation with private companies, which belong to relatives of some other government officials, illegally demolishes good-built houses in the central areas of the Baku city with highest land prices. They simply need land in good locations for the new construction projects. They abuse their power.

In 2012 the Court of Azerbaijan Republic decided that our appartment was demolished unlawfully and that Azerbaijan authorities and Azinko Company shall pay me and my sister a financial compensation for the demolished appartment and the moral damage. The value of the compensation was significantly lower than the real financial damage, which was caused by Azerbaijan authorities to our family. However after the decision was made the judge, which took the decision, was fired and we did not get the court decision in written form for about one year. The authorities payed us only a part of the compensation. We did not agree with the low value of the compensation and applied to the appeal court. We wrote several appeals to different courts till the Highest Court of the Azerbaijan Republic. The final decision of the court system of Azerbaijan Repulic was that we do not have right to get any compensation for our demolished appartment. The small sum of money, which was already payed to us, was payed by mistake and we did not have rights to get this compensation. We think that this decision of the court system of the Azerbaijan Republic is very unfair because we did not get instead of our demolished appartment neither another comparable appartment nor fair financial compensation.

At the end of the lawsuit in Azerbaijan the final decision was, that we shall get a compensation for our apartment. In 2013 the company, which demolished my house, paid me a part of the compensation for the damage caused by demolishing of my apartment. But this compensation did not cover the costs of the apartment and the whole damage, which was caused to me, my sister and other family members. The authorities did not pay for the material and moral damage, which was caused to us. After many years lawsuit in Azerbaijan we exhausted all legal possibilities to get an appropriate compensation for our apartment. That is why we decided to apply to European Court for Human Rights for protection of our human rights.
